Medical malpractice is a failure on the part of a doctor, nurse, emergency medical center, or other health care provider to comply with accepted medical standards. As many as 98,000 patients die annually in hospitals alone due to medical errors, according to a study completed by the Institute of Medicine of the National Academy of Sciences. If you or a loved one has been seriously injured because of medical malpractice, take immediate legal action to protect your rights.
The Pittman Firm, P.A. has long had the honor of representing medical malpractice victims. The work of its founding attorney, Wes Pittman against a military hospital for its staff's repeated malpractice in cardiac care of various retirees resulted in a worldwide change in the way the military screens patients suffering from chest pain. His efforts have been credited with saving hundreds of lives. His well-versed legal insight regarding medical malpractice could prove to be invaluable to your case.

According to Florida Statutes section 95.11(4)(b) the statute of limitations on medical malpractice claims in Florida is two years. This means you have two years from the date of your injury to file a claim or you will most likely be unable to file one. Since the circumstances surrounding suffering an injury through medical negligence are so different than that in another accident such as a car accident, Florida recognizes special extensions in some cases. One of these extensions allows injury victims a longer time period to file if they did not discover their injury initially.
In cases such as this, the statute of limitations “clock” begins on the date that the injury was discovered or should have reasonably been discovered. It is important to note that there is a four-year deadline to file a claim regardless of when an injury is discovered. If you discover that your injury was kept from you intentionally, the court may extend the statute of limitations even further. If you have any questions on how the statute of limitations may affect your case, don’t hesitate to contact our firm right away.
