Premises Liability

Usually referred to as a "slip and fall" or "trip and fall" injury, a premises liability claim arises as a result of an injury from a property owner's negligent creation of an unsafe condition, the failure to repair an unsafe and dangerous condition, and/or its failure to warn a business or personal visitor that the dangerous condition exists. Many such injuries occur in stores when obstacles are placed where shoppers can fall over them, in parking lots when the owner has permitted an uneven surface to develop due to deterioration of the paving, and to vacationers walking down improperly constructed stairs in resort hotels or condominiums.
