The potential harm of using e-cigarettes is in the headlines on a regular
basis these days. The main harm is not the potential for adverse health
effects, but what can happen if an e-cigarette malfunctions and blows
up on a user.
In Indiana the police were called to
the scene of a wrecked semi-truck that took just under three hours to clean up. According to the police who
arrived on the scene, the cause of the wreck was an exploding e-cigarette.
The reports are that the driver was using the e-cigarette when it exploded
in his face, caused him to lose control of his truck and swerve onto the
ditch next to the road.
Fortunately for this driver and others on the road, no one was seriously
injured as a result of the crash. The driver himself is reported to have
sustained injuries to his face and hands because of the exploding e-cigarette.
Of course, in different circumstances this could have ended badly, even
tragically, for more people.
California Teen Allegedly Injured From E-Cigarette
Another report out of California alleges that a teen’s leg was badly burned
after an e-cigarette exploded in his pocket. According to the witness to the event, the e-cigarette left a large black
circle on the teen’s pants, and the cigarette went off like a bottle
rocket, injuring the teen. Stories like these should be cause for concern
among users of e-cigarettes, but they should also put the e-cigarette
industry on notice.
These are not the first reports of these new smoking devices causing injury
to their users. In fact, the stories about the dangers of these devices
continues to build. Even though this industry has benefited from little
regulation in the way of restricting who can use this product, the manufacturers,
distributors, and retailers of e-cigarettes all owe a duty to their consuming
public to provide a safe product.
Product Liability Laws
Florida law protects the consumer from dangerous, harmful, and risky products.
When an industry introduces a product that causes injury, every player
in the chain of commerce will be held accountable for the damages they
cause. Nowhere is this protection more necessary than when new products
hit the market and have not gone through extensive testing on safety.
That is the case here where the policy makers are debating what regulations,
if any, should be brought to bear against the e-cigarette manufacturers
for their product.
